Oak Wood Associates Ltd.'s Approach to Collective Bargaining

Today’s environment calls for management and labor to work together as “one team.”  Why?  If we are fighting among ourselves we are not keeping an eye on the competition or scanning the external environment.  However, in union environments, the bargaining process is currently necessary for settling contracts.  But, how can we do it in an efficient and effective manner that has everyone leaving the table with a positive attitude and human relationships intact?

There are two  types of bargaining approaches.  One is called traditional bargaining.  Traditional bargaining places the emphasis on the relative power of the parties and their willingness to use it both in regard to specific issues as well as overall settlement.

Interest based bargaining (IBB) is an alternative style of negotiating that trained negotiators use to achieve positive results for both parties.  It is a style that uses principles, assumptions, steps, and techniques that are distinctly different from traditional adversarial bargaining.

IBB is not a replacement for adversarial bargaining but is  an alternative that offers distinct advantages in a proper setting that all parties should  first buy into before pursuing.  These include:

  • an enhanced and cooperative relationship      

  • heightened respect and trust among the parties

  • an agreement containing more elegant solutions in terms of needs and permanence

Negotiating teams should be knowledgeable in both types of bargaining and regardless of which approach they use, be skilled in solid negotiating skills.

Violence in the Workplace

The violence in the workplace seminar can be adapted to a half-day or full day session. The seminar includes a video featuring Gary Mathiason, senior partner with the country’s largest employer and labor law firm and Chris Hatcher, clinical psychologist. Between the video and course content, participants will better understand how to protect employees through a managed organizational response. Outcomes include:

  • consistency of the perpetrator profile
  • clear behavioral warning signs
  • typical co-worker behavior
  • concrete steps to manage these incidents and attempt to prevent workplace violence before it happens

Sexual Harassment

The sexual harassment seminar is also adaptable to a half day or full day seminar. A video is included and together with the course, outcomes include:

  • defining the overt and covert sexual harassment behavior
  • setting standards of behavior within the workplace/pitfalls to avoid
  • concrete steps to manage incidents and attempt to prevent it before it happens

Career Assessment/Recruitment and Selection

Oak Wood Associates Ltd. has always had through its associates, the services of career assessment and assessment batteries for selection of new hires. However, we have formalized it by packaging it with our service of process improvement for recruitment and selection. The package may involve any of the following or the package in total:

  • Job analysis of a new or current position (or the method to do it with any position)
  • Development of the competencies needed for the position
  • Recruitment and selection activities geared to the competencies desired which include simulated activities as well as a career assessment by a clinical psychologist with a background in corporate development
  • Decision-making tools for making the decision and developing a professional growth, development, and coaching plan for the new hire
  • Formalizing the entire process to be your organization’s ongoing recruitment and selection process
